An Employment Tax Health Check is a recommended preventative measure that helps a company get their tax affairs in order and as compliant as possible should HMRC decide to carry out a PAYE Inspection visit. This type of inspection relates to Employment Tax and legislation in this area can be complex and changes frequently. It's common practice for HMRC to undertake routine visits every 6 years which many employers have become accustomed to. However, PAYE Inspection visits are due to become more frequent with HMRC increasing the number of compliance officers they employ, working towards their target of 22,000 officers by 2020.
Companies most likely to receive one of these visits are those deemed to be a 'high risk'. High risk companies in the eyes of HMRC are those from industries where they have historically uncovered tax problems relating to things like company cars, fuel benefit, and high spend on travel, subsistence and entertaining.
HMRC have been known to drag their PAYE Inspection visits out over an extended period of time whilst they work through physical records such as expense claims, purchase invoices, petty cash records and the like. As you may imagine this process can cause significant disruption to a business and its day to day running. There is also a personal time cost as HMRC are likely to also carry out a detailed interview, typically with a series of follow up questions.
There are also financial implications should HMRC find any wrongdoing. No matter how diligent an employer may have been, the extent and complexity of the PAYE Inspection often results in HMRC uncovering something that puts the company at risk of being fined. Even small infractions can result in costly fines as HMRC may look to recover liabilities, interest and penalties going back years.
